What to know about the Sexual Harassment Training Deadline on Jan 1, 2021

There is no industry free of sexual harassment. Unwanted advances or off-color jokes happen everywhere from the factory floor, in back rooms at retail stores, and misconduct has been fueled by remote online work due to increased digital communication and lack of visibility around how employees are engaging. Leaders take note: Sexual harassment training is the driving factor in reducing misconduct in the workplace.

Additionally, 11% of in-office employees and 12% of remote workers reported experiencing sexual harassment at work, according to Ultimate Software’s State of Remote Work Report. So if you manage people or are an HR leader, this deadline is important for you.

The Training Deadline

It is the employer’s responsibility and obligation to protect their employees against sexual harassment in the workplace. Last August, Gov. Gavin Newsom signed Senate Bill (SB) 778 into law, which requires California employers with five or more employees to provide sexual harassment prevention training to all employees. Employers have a deadline of January 1, 2021 to complete this mandatory one- or two-hour employee training to be compliant.

The new law provided a one-year extension for the training with a current deadline of January 1, 2021. Employees have a six-month window after hire or promotion to complete this training in order to stay compliant. All certified Sexual Harassment Prevention Training is valid for 2 years for each employee.

  • Non-supervisory employees require a 1-hour training every 2 years.
  • Supervisors require a 2-hour training every 2 years.

With this new bill, employers who provided employee training in 2018 must provide subsequent training by the end of 2020 to stay compliant. Employers who trained employees in 2019 are not required to provide additional training until 2021 and every two years after.
